Information from our customers regarding implementation of the requirements of the Act to implement Directive (EU) 2019/882 of the European Parliament and the Council on accessibility requirements for products and services and to amend other laws, of 16 July 2021(German Accessibility Improvement Act (Barrierefreiheitsstärkungsgesetz - BFSG)

We firmly believe that the Internet should be available and accessible to everyone, and we are committed to providing an online shop that is accessible to the widest possible range of users, regardless of their motor, visual, or cognitive abilities.
Within the framework of this informational text, we would like to inform you about the following topics:
• The requirements of the Accessibility Improvement Act (Sections II. and III.) that are particularly relevant to our online shop and the services offered through it,
• our online shop and the services provided through it (Section IV.),
• the measures we have taken and may still need to take to implement the requirements of the Accessibility Improvement Act (Section V.),

"Appendix 3 (to Sections 14 and 28 of the Accessibility Improvement Act)
Information on services that meet the accessibility requirements
1. The service provider shall indicate in its General Terms and Conditions of Business or in another clearly visible manner how its service, within the meaning of Section 1 (3), complies with the accessibility requirements of the legal regulation to be issued under Section 3 (2). The corresponding information shall include a description of the applicable requirements and cover, insofar as relevant for the assessment, the nature and execution of the service. In addition to the requirements relating to consumer information under Article 246 of the Introductory Act to the German Civil Code (Einführungsgesetz zum Bürgerlichen Gesetzbuch), the information, where applicable, shall contain at least the following elements:
a) a general description of the service in an accessible format;
b) descriptions and explanations necessary for understanding the execution of the service;
c) a description of how the service meets the relevant accessibility requirements set out in the legal regulation to be issued under Section 3 (2);
d) specification of the competent market surveillance authority.
2. To comply with the requirements under Section 1 of this appendix, the service provider may fully or partially apply the harmonised standards and technical specifications whose references have been published in the Official Journal of the European Union.
"The purpose of this law is to ensure the accessibility of products and services (...) in the interest of consumers and users. This strengthens the right of people with disabilities to participate in society and takes into account the harmonisation of the Single Market..“ (Section 1 (1) of the Accessibility Improvement Act)
"Products that an economic operator makes available on the market, and services that it of-fers or provides, must be accessible. Products and services are accessible if they can be found, accessed and used by people with disabilities in the generally customary manner, without particular difficulty and fundamentally without external assistance. (…)" (Section 3 (1) of the Accessibility Improvement Act)
Clothing and accessories of the brand "OLYMP" are sold to end consumers (customers) through our online shop www.olymp.com. The sale of these OLYMP items constitutes therefore the primary purpose of our online shop. Via the respective country versions of our online shop, we deliver directly to customers from Germany, Austria, France, Belgium, the Netherlands, Luxembourg and Switzerland. Additionally, customers from the entire European Union as well as from Switzerland can order through the various country versions of our online shop and have the ordered items delivered to Germany, Austria, France, Belgium, the Netherlands, Switzerland or Luxembourg.
The process of purchasing an item in our online shop generally runs as follows:
Customers select an item via navigation or search and place it in the shopping basket in the desired size. Customers choose either to log in (existing customer account), register as a new user or continue as a guest. Customers enter the necessary data for the billing and delivery address, select the desired payment method and then bindingly complete the purchase.
We also offer the following extra services in Germany and Austria:
– Store-Services: Instore Order (only in Germany and Austria), Click & Collect (only in Germany and Austria), Click & Reserve, Personal Shopping, Store Finder. What have we done to make our online shop and the services offered through it accessible?
To make our online shop and the services offered through it accessible in accordance with Section 3 (1) of the Accessibility Improvement Act, we first of all conducted a comprehensive analysis of our online shop together with an external service provider and, in this context, examined whether and where the online shop may contain potential barriers that need to be eliminated within the framework of implementing the requirements of the Accessibility Improvement Act.
Once the results of this analysis were available, we took the following measures:
1) Accessible keyboard operability: We have ensured that our online shop can be operated predominately using the keyboard.
2) Focus states and (colour) contrasts: We have ensured that almost all interactive elements have a visible focus in order to thus enhance user-friendliness. We have also ensured that nearly all color and other contrasts are sufficiently strong to guarantee good visibility and recognizability.
3) Structuring of text content: We are continually working to adapt heading hierarchies and structured tabular formats in order to make navigation through our online shop easier for screen readers and other tools. Since this is an ongoing improvement process, however, existing heading hierarchies continue to be reviewed and optimised.
4) Multimedia content and autoplay: To improve the accessibility of our multimedia content, we have started equipping videos with a play button so that they no longer start automatically when the page loads. Users can thus decide for themselves if and when they want to play a video.
5) Alternative texts: We are continuously working to make all alternative texts ("alt texts") on our website accessible. In many cases, generic descriptions have already been replaced with meaningful and content-relevant alt texts. Existing alternative texts are continuously reviewed and optimised. Our goal is to ensure comprehensive and accessible use of all image content.
6) Accessible forms and status messages: We have already implemented comprehensive measures to make forms and status messages accessible. Many elements are clearly labelled, formulated in a comprehensible way and accessible to screen readers. Since this is an ongoing improvement process, however, existing forms and status messages continue to be reviewed and optimised. Our goal is to ensure comprehensive and accessible use of all forms and display of all status messages in the long term.
Through the implementation of these measures, our online shop and the services offered through it are discoverable, accessible, and usable for people with disabilities in the generally usual manner, without undue difficulty and largely without external assistance, and are therefore "accessible" within the meaning of Section 3 (1) of the Accessibility Improvement Act.
We shall nevertheless also implement the following measures in the near future:
• Continuous improvement of the semantic structure of all website content, in particular for even better and clearer navigability of the website.
• Continuous revision of all multimedia content and regular review of video content to determine whether and to what extent it is necessary to provide subtitles or descriptive transcripts to ensure understanding of the video content.
• Further improvements to accessibility in various areas of the online shop, such as for example the newsletter section, the store finder, the size guide, the cookie settings, and the sustainability information related to our products.
• Regular assessments of the website's optimal usability with common assistance systems such as screen readers, zoom and contrast settings, and keyboard-only navigation.
The competent market surveillance authority for carrying out the tasks associated with the Accessibility Improvement Act is the newly established "Market Surveillance Office of the Federal States for the Accessibility of Products and Services" ("Marktüberwachungsstelle der Länder für die Barrierefreiheit von Produkten und Dienstleistungen" - MLBF), based in Magdeburg.
