Preliminary Remarks
(1) These General Terms and Conditions (together with the documents referred to herein) govern access to and use of the country version of the OLYMP Online Shop for Italy (further on also “the version of the OLYMP Online Shop for Italy” and “the Italian version of the OLYMP Online Shop”), as well as the purchase of products through the Italian version of the website www.olymp.com.
(2) Please read these General Terms and Conditions, OLYMP Privacy Policy and Cookie Policy carefully before using the OLYMP Online Shop or placing an order.
(3) By accessing the Italian version of the OLYMP Online Shop or submitting an order, the Consumer acknowledges and accepts these General Terms and Conditions and the data protection policies.
(4) In case of questions or requests for further information regarding these General Terms and Conditions or the applicable data protection rules, Consumers may contact us using the contact details provided in § 10.
(1) The following General Terms and Conditions apply to all business transactions initiated and processed via the Italian version of the OLYMP Online Shop between the Consumer, and OLYMP Digital KG (hereinafter also referred to as "OLYMP"). Any deviating terms proposed by the customer shall only apply if expressly accepted in written form by OLYMP.
(2) OLYMP reserves the right to revise and amend these General Terms and Conditions at any time. The Consumer will be subject to the General Terms and Conditions in force at the time of the order, unless a modification is required by applicable law or by order of a competent authority, in which case such change may also apply to orders already placed.
(3) The goods and services offered via the OLYMP Online Shop are intended exclusively for Consumers as end users. For the purposes of these General Terms and Conditions, a "Consumer" means any natural person who acts for purposes unrelated to any entrepreneurial, commercial, artisanal, or professional activity that may be carried out, in accordance with Article 3 of the Italian Consumer Code (Legislative Decree no. 206/2005).
(4) The goods and services offered via the OLYMP Online Shop are intended for Consumers who are 18 years of age and over only. Consumers under the age of 18 are not permitted to place orders independently and may only use the services under the supervision and with the consent of a parent or legal guardian.
(5) The OLYMP Online Shop offers individualized versions for each of Germany, France, the Nether-lands, Austria, Belgium, Switzerland, Luxembourg and Italy. When accessing www.olymp.com for the first time, the Consumer will be asked which country version would like to access. This selection will be stored using technical cookies to improve the functionality and navigation experience of the website. For more information, please refer to OLYMP Cookie Policy and Privacy Policy. Consumers will be free to switch to another version at any time; to do so, by selecting the respective country in the Countries section in the footer of the OLYMP Online Shop.
The selection of a country version determines the geographical scope of the commercial offer (in-cluding delivery areas, product availability, and applicable pricing). It also defines the target Con-sumer market to which the offer is directed.
The applicable Consumer protection law is determined based on the country of residence of the Consumer and the country version selected, as further detailed in § 2(4).
In addition, the versions of the OLYMP Online Shop for Germany, France, the Netherlands, Austria, Belgium, Switzerland and Luxembourg are available in four languages: German, English, French and Dutch. The version of the OLYMP Online Shop for Italy is available in three languages: Italian, Ger-man and English. Consumers can select the preferred language in the footer of the OLYMP Online Shop. The selection of the display language for the OLYMP Online Shop will not affect the country version of the OLYMP Online Shop selected.
(1)By placing an order through the OLYMP Online Shop, Consumers confirm the purchase is made ex-clusively for personal and non-commercial purposes.
(2) The presentation of the goods offered in the OLYMP Online Shop does not represent a binding of-fer to conclude a contract, but rather an invitation to the Consumer to place an order.
(3) Each order placed via the OLYMP Online Shop constitutes a binding offer to conclude a sale for the items included in the cart. After receipt of the order, OLYMP will send an email confirming receipt (“Order Confirmation”) within a short period. The contract is considered concluded upon OLYMP’s transmission of the Order Confirmation. Should the offer not be accepted, and a payment has al-ready been executed, the corresponding amount shall be reimbursed in full to the Consumer, without undue delay and using the same means of payment employed for the original transaction, unless expressly agreed otherwise.
(4) The purchase contract is concluded in the Italian language and is governed by the Consumer protec-tion rules and mandatory provisions applicable in Italy. In case Consumers selected another lan-guage during the checkout process (German or English), the contract may be concluded in that lan-guage as well.
(5) A copy of the contract, the order details and these General Terms and Conditions will be sent to the Consumer by e-mail in a durable medium after the order is placed. The General Terms and Condi-tions are also available at any time on the OLYMP Online Shop. Once the ordering process has been completed, the contract text will no longer be accessible via the website.
a. Consumers have a right of withdrawal from the purchase contract without giving any reason, within 14 days from the day on which the Consumer, or a third party other than the carrier and indicated by the Consumer, acquires physical possession of the goods purchased. In the case of a contract relating to multiple goods ordered by the Consumer in a single order and delivered separately, the withdrawal period shall expire after 14 days from the day on which the Consumer or a third party, other than the carrier and designated by the Consumer, ac-quires physical possession of the last item.
b. The right of withdrawal may not be exercised for sealed goods which are not suitable for re-turn due to health protection or hygiene reasons and were unsealed after delivery (e.g. un-derwear, undershirts, or socks) and goods which are made to measure or clearly personalized (e.g. items with custom embroidery or alterations). In the case of hygiene-sensitive items such as underwear, undershirts and socks, the right of withdrawal shall be allowed only if the goods are returned unused, unwashed, undamaged, and with all original labels and packaging intact.
c.To exercise the right of withdrawal, the Consumer must inform OLYMP Digital KG (Höpfigheimer Str. 19, 74321 Bietigheim-Bissingen, Germany, phone: 00 800 65967222, e-mail: [email protected]) of the decision to withdraw from the contract, before the expiry of the withdrawal period as indicated on the previous §3(1)(a) has expired, by means of an unequivocal statement (e.g. a letter sent by post or an e-mail). Consumers may, but are not obliged to, use the model withdrawal form provided at the end of these General Terms and Conditions. Consumers may also submit the withdrawal declaration electronically via email. In this case, OLYMP will promptly send the Consumer a confirmation of receipt of the withdrawal via email. Consumers can also exercise their right of withdrawal online at www.olymp.com. To do so, they can use the OLYMP withdrawal button. This button can always be found in the footer of the OLYMP Online Shop at www.olymp.com, regardless of which page of the shop they are currently viewing. The OLYMP withdrawal button is labelled 'Withdraw from contract'. If the consumers use this online function, OLYMP will immediately send them a confirmation of receipt on a durable medium (e.g. by email), containing information on the content of the withdrawal declaration as well as the date and time of its receipt.
(2) Effects of withdrawal:
a. If the event that the right of withdrawal from the purchase contract concluded through the OLYMP Online Shop, OLYMP will reimburse to the Consumer all payments received from the same, including the costs of standard delivery (with the exception of the supplementary costs resulting from the selection of a delivery method other than the least expensive type of standard delivery offered by OLYMP) without undue delay and in any event not later than 14 days from the day on which OLYMP is informed about the decision to withdraw from the con-tract.
b. OLYMP will carry out such reimbursement using the same means of payment used by the Consumer for the initial transaction, unless the Consumer has expressly agreed otherwise and provided that the Consumer does not incur any fees as a result of such reimbursement. OLYMP may withhold reimbursement until the returned goods are received, or proof of their return is provided, whichever occurs first.
c. Consumers shall send back the goods or hand them over to OLYMP without undue delay and in any event not later than 14 days from the day on which Consumers communicate the with-drawal from the contract – and the deadline is considered met if the goods are dispatched be-fore the 14-day period has expired – to the following address:

d. Consumers will have to bear the direct cost of returning the goods, unless otherwise explicitly stated by OLYMP.
e. Consumers are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

(2) The costs of returning the goods are borne by OLYMP, if Consumers use OLYMP Return Service under the conditions set out below.
(3) The OLYMP Return Service is available to Consumers subject to the following conditions:
a. the goods must be returned in the same condition at the time of return as at the time of delivery;
b. items that have been used by Consumers in a way exceeding what is necessary to check the nature, condition, characteristics and functioning of the goods, i.e. that goes beyond what is necessary to try on the articles, are expressly excluded from the OLYMP Return Service. This includes, for example, worn, damaged or washed goods. Items must be returned complete with all original labels, tags, accessories, and packaging;
c. Consumers must indicate the reason for returning the goods and must print out and use the return label for shipment by the shipping provider designated by OLYMP. Consumers may request a return label through the customer account or by contacting OLYMP Customer Service;
d. the lodgement of a return as part of OLYMP’s Return Service is always only possible to the shipping provider specified by OLYMP, and must be returned from the same country where the delivery originally took place. If returned from a different country, OLYMP may charge additional shipping fees or refuse the request;
e. the 30-day deadline is deemed met if the goods are handed over to the courier before expiry of the 30-day period;
f. If the original packaging is lost or damaged, Consumers must ensure that the goods are adequately packaged for return, under the Consumer’s responsibility and at the Consumer’s own expense.
(2) As a general rule, payments can be made, depending on availability at checkout:
a. by Credit Card (Verified by Visa or MasterCard Secure Code), carried out by PAYONE GmbH (see § 4 (3));
b. by Apple Pay;
c. by Paypal.
(3) Payments made by credit card (including Apple Pay) will be processed by PAYONE GmbH, Lyoner Straße 9, 60528 Frankfurt am Main, Germany; registered office Frankfurt am Main; Frankfurt am Main trade register, HRB 116860. Consumers’ credit card account is charged after OLYMP has shipped the goods. The billing text on the credit card billing reads: “www.olymp.com”.
(4) Consumers are entitled to exercise a right of retention only to the extent that the counterclaim relates to the same contractual relationship with OLYMP.
(5) The goods shall remain property of OLYMP until full payment of the purchase price has been received.
(6) Shipment shall occur only upon OLYMP’s receipt of full payment of the purchase price. Any delivery periods indicated on the OLYMP Online Shop shall run from the date on which receipt of payment is confirmed. In any event, OLYMP shall deliver the goods without undue delay and, unless otherwise expressly agreed (including in the case of pre-orders), no later than thirty (30) days from the conclusion of the contract. The foregoing is without prejudice to the information obligations set out in §§ 2 and 6 and to the statutory rights of the Consumer.
OLYMP Gift Cards (see § 8 below) can only be delivered to Germany and Austria.
To ensure proper order processing, Consumers must place their order through the country-specific version of the OLYMP Online Shop corresponding to the delivery address (e.g., products ordered through the country version for delivery to Germany will be shipped only to Germany). Orders placed through a country version that does not match the selected delivery destination will not be accepted.
(2) Shipping costs can vary depending on the delivery region, the delivery method and the nature of the order. For more information on cost of shipping, please refer to OLYMP Shipping Costs page.
(3) Goods will be delivered in accordance with the details confirmed at the time of the order.
Delivery and service deadlines and dates must be considered indicative and non-binding, unless otherwise agreed in writing between OLYMP and the Consumer.
OLYMP reserves the right to make partial deliveries, where reasonable.
(2) Under the legal warranty, OLYMP is liable for any lack of conformity existing at the time of delivery that becomes apparent within two years (24 months) from the date of delivery of the goods. To exercise the warranty rights, the Consumer must notify OLYMP of the lack of conformity within two months from the date on which it was discovered. In the event of a lack of conformity, the Consumer is entitled to have the goods brought into conformity, at no cost, through repair or replacement. Where these remedies are not available or are disproportionate, the Consumer may request a proportional price reduction or termination of the contract, in accordance with the conditions set out in the applicable law.
(3) To benefit from the legal warranty, the Consumer must report the defect within two months from the date it was discovered.
(4) Without prejudice to statutory Consumer rights, OLYMP shall be liable only for direct and foreseeable damages that constitute the immediate and necessary consequence of a contractual breach, unless the damage was caused by wilful misconduct or gross negligence. OLYMP shall not be liable for any losses incurred, loss of profit, or any other damages that are not an immediate and direct consequence of its non-performance, or that were not foreseeable at the time the purchase contract was concluded, except in cases of wilful misconduct or gross negligence.
(5) Where OLYMP’s liability is lawfully excluded or limited, such exclusion or limitation shall also apply to its representatives, employees, and agents, insofar as permitted by applicable Consumer protection law.
(1) The collection, processing, and storage of Consumers’ personal data by OLYMP are carried out in compliance with applicable data protection legislation, including Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR) and relevant national laws.
(2) Consumers’ personal data are processed to the extent necessary for the execution and performance of the contract. Any use of the Consumers’ data for purposes other than contractual performance will only take place with the Consumers’ explicit consent, unless otherwise permitted by law. (1) These General Terms and Conditions and any contract concluded through the Italian version of the OLYMP Online Shop shall be governed by and interpreted in accordance with Italian law (in particu-lar, Legislative Decree No. 206/2005 – Italian Consumer Code, Legislative Decree No. 70/2003 on electronic commerce, and — where not otherwise regulated — the relevant provisions of the Ital-ian Civil Code). This choice of law does not affect the application of any mandatory Consumer protection provisions provided by the law of the country in which the Consumer resides at the time of the order.
(2) For any legal proceedings arising out of or related to the use of the Italian version of the OLYMP Online Shop or the relevant or resulting contracts, the competent court shall be the court of the place of residence or domicile of the Consumer, in accordance with Article 66-bis of the Italian Consumer Code.
(3) In the event of a dispute relating to these General Terms and Conditions for the version of the OLYMP Online Shop for Italy or to any purchase contract concluded via the Italian version of the OLYMP Online Shop, Consumers may make use of alternative dispute resolution procedures, as provided by applicable Italian Consumer protection law. This includes the possibility to initiate an out-of-court settlement process through an authorized Alternative Dispute Resolution (ADR) body.
(4) Consumers may access out-of-court dispute resolution (ADR) procedures, as provided under applicable consumer protection laws. In Italy, consumers may contact a registered ADR body listed by the Ministry of Enterprises and Made in Italy. (5) If any provision of these General Terms and Conditions is found to be invalid, unlawful or unenforceable, such provision shall be considered as never having been included in these General Terms and Conditions and the remaining provisions shall remain fully valid and effective. In such cases, the invalid, unlawful or unenforceable provision shall be replaced — to the extent permitted by law — by the applicable mandatory rule of Italian law that most closely reflects the original commercial intent.
